Terms and Conditions
These Terms and Conditions govern your participation in and use of the services operated by Blackleaf Marketing Solutions, LLC (“Blackleaf,” “we,” “our,” or “us”). By using our platform or participating in our messaging programs, you agree to these terms. Please read them carefully.
1. Program Details
The following disclosures apply to all messaging programs:
- Program Name: Account Notifications
- Message Frequency: You may receive 1 message per day.
- Product Description: Our messaging program provides customers with daily account notifications, including updates on account activity, 2FA, billing updates, rewards status, point expirations, and other essential account-related information.

- Opt-Out Information: You may opt out of receiving messages at any time by replying STOP to any message.
- Message and Data Rates: Standard message and data rates may apply. Please check with your mobile provider for details.
2. Types of Messages
By participating, you agree to receive the following types of messages:
- Daily account updates, billing notifications, 2FA, rewards status alerts, point expiration reminders, order confirmations, and essential account notifications.
3. Costs
Participation in this program may incur standard messaging and data charges from your mobile provider. Free-to-end-user (FTEU) programs will not result in charges.
4. Account Credits and Refund Policy
Our platform operates on a pay-as-you-go credit system. You may load funds into your account to purchase message credits, which are deducted as messages are sent.
Refunds are only available for unused credits. Once a message has been sent, no refund is available for that credit, even if delivery fails or is delayed. Message delivery and content are fully under the sender’s control, and senders are responsible for ensuring message content complies with carrier and content guidelines.
To request a refund for unused credits, contact billing@blackleaf.io. Approved refunds will be processed to the original payment method within 7–10 business days.
5. Digital Delivery / Fulfillment Policy
All products and services are delivered electronically through the Blackleaf platform. Once funds are loaded, credits become immediately available for use. There are no physical goods shipped. For purchases requiring invoice documentation, please contact billing@blackleaf.io.
6. Acceptable Use and Prohibited Behavior
You agree to use our platform only for lawful purposes. You may not use our services to:
- Send unlawful, abusive, defamatory, or misleading content;
- Send spam or unsolicited messages in violation of applicable laws;
- Transmit viruses, malicious code, or engage in activities that disrupt our systems or networks;
- Access, tamper with, or use non-public areas of our systems;
- Impersonate any individual or entity, or misrepresent your affiliation with any person or organization.
Violating these acceptable use terms may result in immediate suspension or termination of your account without notice.
7. Limitation of Liability
To the maximum extent permitted by law, Blackleaf Marketing Solutions, LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use arising from your use of our platform or services. Our total liability for any claim under these Terms shall not exceed the total amount you paid to Blackleaf within the six (6) months preceding the claim.
8. Privacy Policy
Your participation is governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in that policy.
9. Opt-Out Instructions
You may opt out of receiving messages at any time by replying STOP to any message. Upon opting out, you will no longer receive messages from this program.
10. Sender Responsibility and Legal Compliance
You acknowledge and agree that you are the sender of any messages transmitted using the Blackleaf platform, and that Blackleaf acts solely as a technology service provider and communications conduit. Blackleaf does not initiate messages, select recipients, determine message content, or control message frequency.
You are solely responsible for ensuring that all messages sent using the platform comply with all applicable laws, regulations, and industry standards, including but not limited to the Telephone Consumer Protection Act (TCPA), state telemarketing laws, Do Not Call (DNC) requirements, consent and opt-in requirements, and carrier policies.
You represent and warrant that you have obtained all required consents, permissions, and authorizations from message recipients prior to sending any messages, and that you maintain records sufficient to demonstrate such consent upon request.
11. Indemnification
You agree to indemnify, defend, and hold harmless Blackleaf Marketing Solutions, LLC and its officers, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Any messages you send using the Blackleaf platform;
- Your failure to obtain or maintain valid recipient consent;
- Any alleged or actual violation of applicable messaging, privacy, or consumer protection laws;
- Any claim that messages sent on your behalf were unlawful, unsolicited, misleading, or non-compliant.
12. Terms of Use and Updates
Continued use of our platform constitutes acceptance of these Terms and Conditions. Blackleaf may update these terms at any time, and your continued use of the service after updates constitutes acceptance of those changes.
